At last the Court is reining in Andrew Cuomo’s arbitrary rule. State Supreme Court Judge Henry Nowak ruled in favor of Western New York restauranteurs who sued to reopen their establishments. Indoor dining will now be allowed in orange zone establishments limiting seating to 4 patrons per table. This comes in the nick of time to save such businesses from financial ruin. The Governor’s mandate was not borne out by his own research. Fewer than 2 percent of covid cases were linked to restaurant dining. Finally the rule of law is returning to New York State. We await further court decisions limiting the unlawful dictates of a despotic tyrant.
